Section 301 exclusions on Chinese machinery expire November 9, 2026
178 Section 301 exclusions on Chinese goods, 164 product exclusions and 14 for solar manufacturing equipment, expire at 11:59 p.m. Eastern on November 9, 2026. Many cover machinery and industrial components. After that, those products pay the full Section 301 rate, usually 25%, unless USTR extends them again, and there is no open process to request new exclusions.
What the exclusions are
Section 301 tariffs on Chinese goods have applied since 2018. USTR excluded specific products from them, and a limited set of those exclusions has been extended several times. The remaining ones are claimed under HTSUS 9903.88.69 for product exclusions and 9903.88.70 for solar manufacturing equipment.
What changes after November 9, 2026
- Excluded products return to the full Section 301 rate for their list, usually 25%.
- The exclusions never covered the 12.5% forced-labor Section 301 duty in force since July 24, 2026.
- No new exclusion request process is open.
What to do now
- Check your machine's HTS code against the active exclusion annexes with your customs broker.
- Price any order that will be entered after the deadline at the full rate.
- Review whether shipping earlier changes the duty you pay.
- Watch for a USTR notice on a further extension.
